A sworn valuation is an independent and legally recognised assessment of the value of a property. It is submitted in writing to a vendor or buyer pre-sale or a lender following the sale.
Unlike estate agents, a registered valuer is accepted as an expert witness if required to give evidence in court.
Membership of the Australian Property Institute means valuers must conduct themselves and work to the highest calibre, as per Australian Valuation Standards.
Valuers can be called upon to:
- value property at a particular time with the most usual being the date of compilation
- provide a retrospective opinion required for legal or taxation purposes
- offer experience in complicated hypothetical valuations involving future development, i.e. subdivisions.
It is important to note that a valuation may need to be revisited sometimes due to rapid movement in the market.
Sworn Valuations are best for:
- tax, estate and marital separation purposes, deceased estates and more
- high-pressure selling situations where an error-free, fair sale split is needed due to critical legal ramifications
- banks to engage valuers to ensure they advance money within acceptable margins.
